Terms and Conditions

These general terms and conditions apply to all offers and quotations from, agreements with, deliveries and services from Maison Vacances France and/or Village de Montmarsis. Deviations only apply if and insofar as they have been confirmed in writing by Maison Vacances France and/or Village de Montmarsis. These general terms and conditions apply exclusively to legal relationships between Maison Vacances France and/or Village de Montmarsis and tenants of holiday homes, safari tents, meeting rooms and all third parties: owners and suppliers.

Product description

Each holiday home has been carefully selected by Maison Vacances France and/or Village de Montmarsis. Maison Vacances France and/or Village de Montmarsis guarantee the accuracy of the description of the holiday homes, with the understanding that a deviation of 5% of the specified living area is considered acceptable. The description and impressions of the holiday home and the immediate surroundings, including amenities, furnishings, facilities and recreational options, may differ due to their nature or due to interim changes or seasonal influences.

Amendments

Certain items such as a high chair, baby bed and BBQ can be indicated when booking. Changes can still be made after a booking. MVF and/or Village de Montmarsis will implement these changes where possible. You can let us know: info@montmarsis.com, mention your name, booking number, which items/options and the quantity.

Usage

The tenant must use the living space and outbuildings correctly. Upon departure, the tenant must leave the holiday home in a reasonable condition. Crockery must be washed and put back in the intended places (There is a dishwasher in every accommodation). The reception has the right to carry out a final inspection upon the tenant’s departure. If the reception concludes that the living space has not been used correctly, the reception is entitled to charge additional (cleaning) costs to the tenant. The beds must not be used without sheets.

Arrival and departure

The tenant can collect the keys to the holiday home at the reception on the agreed day of arrival between 4:00 PM and 6:00 PM. If you arrive outside the stated time, the tenant must report this to the reception in advance. Unless stated otherwise, the tenant must vacate the property no later than the time stated in the rental agreement. If you depart after 10:00 am, an additional day’s rental may be charged.

Injury

The tenant is legally liable for damage caused by him, his co-tenants and/or pets under his responsibility. The tenant must immediately report any damage that may have been caused to the accommodation, the building or the objects contained therein to the reception. Repair or replacement costs will be reimbursed by the tenant upon first request from reception. Maison Vacances France and/or Village de Montmarsis have the right to use the deposit for these costs.

Booking

A booking can only be made in writing via the website, by e-mail or by post. The booking fee is 100 euros and is included in the rental price. The down payment is 25% of the rental amount. You must make the deposit within 5 working days of receiving the booking confirmation and invoice. When Maison Vacances France has received the deposit, the reservation is final.

The tenant will receive a booking confirmation and an invoice by e-mail within a few days after registration. The invoice is structured as follows:

• Down payment 25% of the rental amount within 5 days after receipt of booking confirmation and invoice

• Remaining travel sum

The booking is final after payment of the deposit.

Payments must be made by transfer to the account number of Maison Vacances France stated on the invoice, stating name, reservation and invoice number. Any bank charges will be borne by the tenant.

Cancellation insurance

Things may happen that make it necessary to postpone or cancel the trip/holiday. For a valid reason, the cancellation insurance will reimburse 100% of the travel price regardless of the time of cancellation (also under certain circumstances during the holiday). You can easily take out travel/cancellation insurance online or from an insurance agent.

Change and cancellation

If the tenant wishes to cancel a booking for reasons that are not covered by this cancellation insurance, cancellation costs per traveler are due:

• booking fee: €100
• from 6 months to 42 days before arrival 25%;
• from 42 to 14 days before arrival 75%; afterwards or in the event of a no-show 100%.

Maison Vacances France and/or Village de Montmarsis reserve the right to charge fees if changes need to be made to the booking after sending the booking confirmation.

In the event of force majeure or unforeseen circumstances, Maison Vacances France and/or village de Montmarsis may cancel the reservation on behalf of the accommodation provider. Unforeseen circumstances and force majeure include: the living space is unsuitable for rental due to natural causes such as flooding, forest fire, earthquake, etc.

Maison Vacances France and/or Village de Montmarsis will immediately inform the tenant by telephone or in writing, stating the reason. In this case, Maison Vacances France and/or Village de Montmarsis will try to offer equivalent accommodation under the same conditions. This equivalence of alternative accommodation is assessed by Maison Vacances France and/or Village de Montmarsis based on the category of accommodation, facilities, as agreed at the time of booking.

If Maison Vacances France and/or Village de Montmarsis cannot offer a suitable alternative or if the tenant does not agree with the alternative offered, Maison Vacances France or Village de Montmarsis will refund all or part of the travel sum already paid, without any compensation.

Preferences and essentials

MVF and/or Village de Montmarsis take the wishes and preferences stated when booking into account as much as possible.

Prices and rates

Prices include sales tax but exclude other costs such as cancellation costs. Special additional costs such as cleaning costs, linen rental, municipal taxes determined by and on behalf of the local authorities are stated separately. The prices and rates applicable at any time are exclusively stated on the website of Maison Vacances France and/or Village de Montmarsis.

Payment

In the event of late bookings, Maison Vacances France and/or Villages de Montmarsis have the right to require payment only by bank/credit card or cash.

Maison Vacances France and/or village de Montmarsis have the right to require security for payment both before and after the conclusion of the rental agreement, subject to suspension of the execution of the rental agreement until security has been provided. This right is exercised without prejudice to Maison Vacances France’s right to performance or compensation and/or full or partial cancellation, without any judicial intervention and without Maison Vacances France and/or Village de Montmarsis being obliged to pay any compensation.

What do I commit to?

Maison Vacances France and/or Village de Montmarsis point out that bookings made via the Internet and the resulting rental agreement are final, upon receipt of the deposit. Failure to pay the deposit may result in cancellation of the booking. The cancellation will be confirmed by email.

Deposit

MVA or Village de Montmarsis have the right to request a deposit for the duration of the stay of €300. If payment is refused by the tenant, the rental agreement will be considered terminated on the effective date. The deposit must be paid or secured upon arrival at the park. At that time, additional costs such as extra services and ordered items and cleaning costs will also be settled if these have not yet been paid after the booking.

Any damage found, loss of items present in or at the holiday park and/or excessive pollution, in the reasonable opinion of the manager, will be deducted from the deposit. The remainder of the deposit will be refunded to the tenant within 14 days.

Electronic communications and evidence

Maison Vacances France is not liable for misunderstandings, mutilations, delays or improper transmission of data and messages resulting from the use of the Internet or any other means of communication in the exchange between the tenant and Maison Vacances France and / or Village de Montmarsis (or by the tenant third parties engaged), unless and insofar as there is intent or gross negligence on the part of Maison Vacances France. The administration of Maison Vacances France and / or Village de Montmarsis is deemed to be full proof of the existence, content and execution of the agreement with the tenant in any legal procedure, until proven otherwise by the party that relies on the fact that the evidence is not reliable.

Applicable law

All agreements between the tenant(s) and Maison Vacances France and/or Village de Montmarsis are subject to French law.

Complaints

 Complaints must be reported to reception. If a complaint cannot be resolved to the tenant’s satisfaction on site after consultation with the reception / manager, he can contact Maison Vacances France and / or Village de Montmarsis. The notification of a complaint can be sent in writing to info@montmarsis.com
